1) GENERAL

1.1 These terms and conditions apply when you browse, access or in any other way use the website of BODUM AG, Kantonsstrasse 100, 6234 Triengen, Switzerland+41 41 935 46 00. (hereinafter referred to as “BODUM®” and/or ODNING&REDA®, “we”, “us” or “our”) located at ordning-reda.com (hereinafter “the Website”) and any services or functions made available through the Website, including all on-line sales functions. Provisions, which only apply to on-line sales on the Website are set out in section 3 or are clearly indicated as such.

1.2 These terms and conditions were most recently updated on November 1st 2011 (Version 1). We reserve the right to amend these terms and conditions at any time. All amendments will be posted on the Website and are considered applicable when available to you.

2) APPLICABILITY

2.1 By accessing and using the Website you agree to these terms and conditions and the applicable provisions hereof. If you cannot accept these terms and conditions, in whole or in part, you should not use the Website.

3) USE OF THE ON-LINE SHOP

3.1 Placing of an order

3.1.1 To place an order you shall follow the instructions set out on the website.

3.1.2 The order is considered to be effective when the purchaser has clicked ”place order” button on the “order review screen” and you have received a electronic confirmation from us.

3.1.3 In order to use the on-line shop at the website you must be at least 18 years of age. If you have not yet turned 18 years you must have the legal right to use the on-line shop.

3.2 Delivery area

3.2.1 Deliveries are only made in United Kingdom.

3.2.2 Deliveries are not made to PO Box numbers.

3.3 Delivery period

3.3.1 Delivery is usually made within 10 business days after receiving your order. Should an article be currently out of stock, we will let you know as soon as possible when delivery can be expected.

3.4 Delivery Charges

3.4.1 For orders exceeding 35 EURO delivery will be made to your address in United Kingdom free of charge.

3.4.2 Delivery charges for deliveries under 35 EURO will be 9,90 EURO.

3.4.3 Delivery is at the risk of the Costumer. However, you can rest assured that ORDNING&REDA® will do everything in our power to assure that your order will arrive promptly and in perfect condition. Our products are shipped with DPD during working hours and we would appreciate if you could make sure that somebody is available to accept your consignment.

3.5 Right to cancel by returning the goods

3.5.1 We want our Customers to be satisfied with their ORDNING&REDA® products. Therefore, if you are not fully satisfied you may return the products by cancelling your order and returning the products at any time within 14 days from the day you have receive the goods, in accordance with the Danish Act on Consumer Agreements. If you received the goods on e.g. 1 June you will be able to cancel your order through to 15 June. If the last day of the mentioned 14-day period is a Holiday or a Saturday you can wait until the first following weekday to inform us that you will cancel your order.

3.5.2 You can also cancel the purchase by refusing to receive the goods.

3.5.3 We will provide you with written information about the right to cancel and about the purchased goods. The period in which you have the right to cancel will not come into force before you have received this information. If the information we provide you is imperfect, the period for cancelling expires at the latest 3 months from the day you received the goods. However, if the information is rectified during this period, you have the right to cancel during a 14-day period from the date you received the rectified information.

3.5.4 Goods returned for refund will only be accepted in unused, perfect condition and in the original packaging. Such goods must be returned within the 14 (fourteen) day-period mentioned above. It is sufficient that the goods are returned by post within the 14-day period.

3.5.5 To use your right as set out in this clause 3.5 you must have notified Ordning & Reda during the period mentioned above. Notice can be given by sending an e-mail to: [email protected] or by letter to ORDNING&REDA®, Humlebæk Strandvej 21, 3050 Humlebæk either separately or included with the returned goods. Please send the goods with original invoice to the following address: Peter Bodum A/S Kometvej 12 6230 Rødekro The goods must be sent at the Customer’s cost.

3.5.6 After we receive your returned goods you will receive your refund. Please allow 14 days for the refund to be credited to your account.

3.6 Prices and VAT

3.6.1 The applicable product prices are as specified in the confirmation available prior to your acceptance to purchase the goods.

3.6.2 All productprices are in EURO and are inclusive of VAT and all other applicable fees at the prevailing rate. All prices in these terms and conditions are as indicated.3.6.3 We reserve the right to change the prices, without prior notice, due to imposed taxes, charges, premiums, etc. for completed agreements but where delivery has not yet taken place.

3.7 Payment

3.7.1 We accept payment by credit card (Master Card, Visa Card, American Express, JCB).

3.7.2 Goods will remain the property of BODUM® until payment has been made in full.

3.7.3 Any and all data required by us for order processing purposes will be treated as strictly confidential in accordance with our Privacy Policy. Please see our Privacy Policy here. The Privacy Policy forms an integrated part of these terms and conditions.

3.8 Right to complain

3.8.1 Electrical appliances are covered by a guarantee which is valid for 2 (two) years from the date of invoice, in accordance with Danish law. There is no guarantee obligation if a fault or damage was caused by handling, maintenance of care that was contrary to our instructions. The purchaser should always consult the relevant instructions and recommendations in the leaflet enclosed with the product.

4) LANGUAGE AND ACCESS TO TERMS AND CONDITIONS

4.1 These Terms and Conditions are available in English.

4.2 We will store all agreements entered into, including your offer and the order confirmation. Further, we do recommend that you file these too, as subsequently the documents will not be accessible.

5) FORCE MAJEURE

5.1 ORDNING&REDA® shall not be liable for any breach of our obligations under these terms and conditions to the extent we are hindered or prevented from carrying out our obligations by any cause outside our reasonable control, including by lightning, fire, flood, extremely severe weather, strike, lock-out, labour dispute, war, riot, civil commotion, malicious damage, failure of any telecommunications or computer system, compliance with any law or accident (or by any damage caused by any of such events).

6) INTELLECTUAL PROPERTY RIGHTS AND THIRD PARTY RIGHTS

6.1 You should assume that everything you see, read or hear on this Website is protected by copyright, design right and/or other intellectual property rights unless otherwise stated, and may only be used in accordance with these terms and conditions. ORDNING&REDA® does not warrant or represent that your use of materials displayed on this Website will not infringe rights of third parties not owned by or affiliated with ORDNING&REDA®. Images, illustrations, graphics, text, etc, are either the property of ORDNING&REDA® or third parties who have licensed their rights to Ordning & Reda. The use of these materials by you, or anyone else authorised by you, is prohibited unless specifically permitted in these terms and conditions. Any unauthorised use of the images may violate copyright laws, trademark laws and/or other regulations and statutes.

6.2 The trademarks, logos and designs displayed on the Website, are the property of ORDNING&REDA® or third parties who have licensed their rights to ORDNING&REDA®. Nothing contained on the Website should be cons1d as granting, by implication or otherwise, any license or right to use any trademark displayed on the Website without the written permission of ORDNING&REDA® or such third party that may own the trademarks displayed on the site.

8) LIABILITY AND COMPENSATION

8.1 ORDNING&REDA® shall only be liable to you to the extent set out in applicable mandatory law. We do not assume any liability for goods being suitable for any particular purpose unless we in writing have approved such suitability.

8.2 Claims for compensation due to mistakes in illustrations, prices or texts are strictly excluded to the extent possible under applicable mandatory law.

8.3 To the extent a claim is due to your actions or inactions contrary to our instructions you shall not be entitled to claim compensation herefore. You are at any time obligated to consult relevant instructions and recommendations provided with the good or otherwise referred to prior to use, if any.

9) CHOICE OF VENUE AND GOVERNING LAW

9.1 Any disputes arising out of these terms and conditions shall be governed by and cons1d under the laws of Denmark, without regard to any conflict of laws principles.

9.2 Any actions arising out of products purchased through the Website shall be decided by the courts of Denmark.>
